J&M Painting LLC - Standard Terms & Conditions

1. Scope of Work
The work to be performed by J&M Painting LLC ("Contractor") will be limited to the services and areas specifically outlined in the signed estimate. Any additional work, changes, or requests beyond the original scope must be approved in writing and will result in a separate quote and charge.
2. Pricing & Payment
• All pricing is based on the agreed-upon scope of work outlined in the estimate.
• A deposit of 50% is required to schedule and begin work.
• The remaining 50% is due upon project completion and customer approval.
• Accepted payment methods include: cash, check, Venmo, Zelle, or credit/debit card.
• Late payments may result in suspension of work or additional fees.
3. Scheduling
Once the deposit is received, J&M Painting will provide an estimated start date. Actual start dates depend on weather, material availability, and crew scheduling. Contractor will make every effort to adhere to the timeline, but unforeseen circumstances (weather, supplier delays, etc.) may affect the schedule. The customer will be notified promptly of any significant delays.
4. Surface Preparation
Proper preparation is essential for quality results. J&M Painting will clean, scrape, sand, prime, and repair surfaces as outlined in the estimate. If additional repairs are discovered during the project (such as wood rot, hidden damage, or structural issues), the customer will be notified before proceeding. These repairs may incur additional costs.
5. Colors & Materials
• The customer is responsible for final color selection. J&M Painting is happy to offer color guidance and recommendations, but the customer must approve all colors before work begins.
• Color samples or test patches can be provided upon request.
• Once paint is applied, color changes may result in additional charges.
• J&M Painting uses high-quality, professional-grade paints and materials. Specific brands or products may be substituted with equivalent alternatives if supply issues arise.
6. Customer Responsibilities
The customer agrees to:
• Provide access to water, electricity, and restroom facilities if needed.
• Remove or relocate furniture, decorations, and personal items from work areas before the crew arrives.
• Secure pets during work hours to ensure crew safety and efficiency.
• Notify J&M Painting of any areas requiring special attention or restrictions (e.g., sensitive landscaping, HOA rules).
• Ensure that parking and entry access are available for crew and equipment.
7. Warranty
J&M Painting warrants workmanship for a period of one (1) year from the completion date. This warranty covers peeling, cracking, or blistering caused by poor application or surface preparation. It does not cover damage caused by weather, improper maintenance, structural movement, or normal wear and tear. Product warranties are provided by the manufacturer and are separate from our workmanship warranty.
8. Weather Conditions
Exterior painting is weather-dependent. Work may be delayed due to rain, snow, extreme heat, or temperatures outside the manufacturer's recommended application range. J&M Painting will notify the customer of any weather-related delays and reschedule as soon as conditions permit.
9. Clean-Up
At the end of each workday and upon project completion, J&M Painting will clean the work area by removing debris, drop cloths, and equipment. The crew will leave the site in a neat and orderly condition. Any paint spills or stains will be addressed promptly.
10. Property Protection
J&M Painting will use drop cloths, plastic sheeting, and masking to protect floors, furniture, fixtures, and landscaping. While every precaution is taken, minor touch-ups or repairs may occasionally be needed. The customer should notify the Contractor immediately of any concerns so they can be addressed promptly.
11. Change Orders
Any changes or additions to the original scope of work must be requested in writing and approved by both parties. A revised estimate will be provided for all change orders. Additional work will not begin until the customer approves the updated pricing and timeline.
12. Cancellation Policy
• If the customer cancels the project before work begins, the deposit is non-refundable but may be applied toward a future project within six (6) months.
• If the customer cancels after work has started, the customer will be charged for all labor, materials, and services completed up to that point. The deposit will be applied toward this balance.
• J&M Painting reserves the right to cancel the project if the customer fails to meet their responsibilities (e.g., nonpayment, denied access, unsafe work conditions). In such cases, the customer will be charged for all work completed.
13. Liability
J&M Painting carries general liability insurance to protect against accidental damage or injury. The Contractor is not responsible for pre-existing damage, hidden defects, or issues not visible during the initial inspection. The customer is responsible for securing valuables and ensuring the work area is accessible and safe.
14. Final Walkthrough
Upon completion of the project, the customer and Contractor will conduct a final walkthrough to review the work. Any concerns or touch-ups will be addressed before final payment is collected. Once the customer approves the work and submits final payment, the project is considered complete.
15. Acceptance of Terms
By signing the estimate or submitting a deposit, the customer acknowledges that they have read, understood, and agreed to these Terms & Conditions. These terms apply to all projects performed by J&M Painting LLC.
